ARN SMARTPHONE APPLICATIONS TERMS AND CONDITIONS OF USE
Arabian Radio Network FZ-LLC (ARN) provides smartphone applications and their related services to you subject to the following terms and conditions.
PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THE APPLICATIONS.
By using ARN’s applications, you have agreed to these terms and conditions. If you do not agree to all of them, you may not use the applications. ARN may change and update these terms and conditions from time to time. Please check them periodically under the ‘Legal’ tab on any of our radio stations’ websites, because your continued use of ARN’s applications is your acceptance of those changes and updates.
Trademarks
‘ARN’, ‘Tag911’, ‘Dubai 92’, ‘RadioShoma93.4’, ‘Hit96.7’, ‘AlArabiya99’, ‘AlKhaleejiya100.9’, ‘City101.6’, ‘DubaiEye103.8’, ‘VirginRadio104.4’ and other applications symbols may be registered trademarks of ARN. All other trademarks, service marks and logos used are the trademarks, service marks or logos of their respective owners. ARN has made reasonable efforts to secure appropriate licences and clearances for all third party intellectual property used in its applications. Please notify ARN of any alleged intellectual property right infringement by emailing legal@ARN.ae
Use of Content and Copyright
Unless specifically stated otherwise, all materiel in ARN’s applications, including (but not limited to) design, text, pictures, graphics, and all software compilations and underlying source code, are the copyright of ARN. ALL RIGHTS ARE RESERVED.
You may use the applications for the purposes for which they are designed and print out or store screenshots of the applications for your own personal use or information or that of your firm or company. Any other use of materiel from ARN’s applications, including reproduction for purposes other than those stated above, publication, modification, sale, distribution, the creation of training materiel, posting or transmission in any way without the prior written consent of ARN is strictly prohibited.
Links to Other Websites
ARN’s applications may contain links to third parties’ web sites. These links are provided solely for your convenience and do not constitute ARN’s endorsement of their content, for which ARN is not responsible in any way. If you decide to access third party websites through links in ARN’s applications, you do so entirely at your own risk and your use of them is subject to the third parties’ own terms and conditions of use.
Advertisements
ARN’s applications may contain third parties’ advertisements, which may contain links to other websites. Unless specifically stated otherwise, ARN does not endorse any product or make any representation regarding the content or accuracy of any materiel contained in, or linked to, any third party’s advertisement.
Access Outside the UAE
ARN is based in the UAE. Access to the content of ARN’s applications may not be legal by certain persons or in certain countries. If you access ARN’s applications from outside the UAE, you do so entirely at your own risk and responsibility for compliance with the laws of your jurisdiction. Recognizing the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable content. In particular, you agree to comply with all applicable laws regarding the transmission of technical data which is exported from the country in which you reside. You may message ARN’s radio stations using ARN’s applications for other matters but you cannot enter competitions. If you do enter and win, you will be disqualified.
Force Majeure
ARN is not liable for any delay, failure or interruption of its applications’ content delivery which is the direct or indirect result of any cause or circumstance that is beyond its reasonable control, including but not limited to failure of equipment or communication line, telephone or other interconnect problem, computer virus, unauthorised access, theft, operator error, severe weather, earthquake or natural disaster, strike or other labour problem, war or governmental restriction.

ARN’s applications are provided on an ‘as is’ basis. ARN makes no representation and gives no warranty of any kind, express or implied, as to the operation of its applications or the information, content, materiel or services available from them, the accuracy, reliability, completeness or timeliness of the applications’ content or that the use of any application will be uninterrupted, timely, secure or error-free. You expressly agree that your use of ARN’s applications is entirely at your own risk. In no event shall ARN be liable for any damages whatsoever (including, without limitation, incidental and consequential damages, lost profits and damages resulting from the use or inability to use an application or its content) whether based on warranty, contract, tort or any other legal theory and whether or not ARN is advised of the possibility of such damages.
Indemnity
You indemnify ARN , its officers, directors, employees, agents, licensors and suppliers against all claims, actions or demands, liabilities and settlements (including without limitation, reasonable legal and accounting fees) which result, or are alleged to result, from your use of ARN application content in a manner which violates, or is alleged to violate, these terms and conditions.
Severability and Waiver
If any provision of these terms and conditions is found to be invalid by any court of competent jurisdiction, the invalidity will not affect the validity of the remaining provisions of these terms and conditions, which will remain in full force and effect. No waiver of any term or condition will constitute a further or continuing waiver of it or any other term or condition.
Jurisdiction
These terms and conditions are governed by, and construed in accordance with, the laws of the Dubai International Financial Centre (DIFC). You irrevocably submit any dispute which may arise out of or in connection with these terms and conditions or the legal relationship established by them to the exclusive jurisdiction of the DIFC courts.
